Colorado Property Management Company Facing Asbestos Exposure Lawsuit

Property management company Willmax Capital Management, Inc. is currently facing charges for releasing asbestos containing fibers into the air during a renovation. Residents of The Overlook at Mile High Apartments in Denver were deemed exposed to the hazardous materials back in February 2014 by health officials. A total of 94 apartment residents were evacuated and relocated to hotels.

The charges are for knowingly violating a federal rule that requires an inspection for the presence of asbestos containing materials prior to any and all renovations and negligently releasing asbestos fibers into the air. Asbestos contamination can lead to serious injury or death. The subcontractor was working the in the hallways to sand and remove carpeting. The carpeting glue contained the asbestos containing material “mastic.”

The property management company’s corporate executive will plea guilty and take responsibility. The hearing is this month for one federal misdemeanor charge. The repercussions could be up to one year in prison and up to a $100,000 fine.

Both the property management company and the corporate executive have been working hard to tighten current policies to prevent similar situations in the future and keep their tenants safe.
