Monterey Contractor Busted for Illegal Asbestos Removal

After over a decade of violating asbestos-related environmental laws and regulations, a Monterey contractor has been found guilty of violating such laws and was fined seven million dollars. The work being performed occurred in Monterey County at Carmel Valley Manor. The renovation work spanned from 1998 until 2013 with failure to survey for asbestos and notify the Monterey Bay Air Resources District (“MBARD”). In addition, the violations included failure to properly handle asbestos-containing materials during removal and disposal. The building owner was also fined $825,000.

As a general contractor or building owner, hiring an environmental consultant to test building materials for the presence of asbestos and/or other hazardous materials is imperative. Both new and old buildings may contain asbestos. Asbestos, specially, is highly regulated due to its increased risk of respiratory diseases during exposure. Asbestos-related laws and regulations are not to be taken lightly or looked over. The act of hiring environmental consultants and specialty contractors to handle these materials properly may delay projects or be an extra expense, but there is truly no cost for safety. Being in violation can cost more than millions of dollars – it can cost lives.

Many contractors have heard that they are allowed to remove up to 100 square feet of asbestos containing materials on their own. Unfortunately, even though a contractor is not required to carry a Department of Occupational Safety and Health (DOSH) license for removing under 100 square feet of asbestos, it does NOT supersede the Cal/OSHA Asbestos in Construction Standard which still applies when removal or disturbance of ANY amount of asbestos containing material takes place during construction related activities.
